The OPPORTUNITY:
Leverage your claims experience and join our team as a Litigation Specialist! This position provides the front-line handling of complex litigated matters arising from commercial general liability, commercial liability umbrella, inland marine, and first-party property claims. The Litigation Specialist is responsible for all aspects of coverage, investigation, negotiation, and resolution of litigated matters within established company and industry Best Practices. This role will work with legal counsel to analyze each case to establish the proper action plans to appropriately defend and timely resolve cases within the highest and best legal and business practices. This remote role will allow you to do your best work from your home office, collaborating virtually with your team daily. You will travel to our Raleigh office for meetings and company events up to four times a year.
Your WORK as a Litigation Specialist will make a difference as you:
- Handle complex commercial general liability and commercial building and business personal property claims involving substantial property damages, construction defect, personal and advertising injury claims, serious bodily injury, complex and high-value loss of use and other types of high exposure claims involving litigated matters arising from claims.
- Analyze and interpret insurance policies, respective industry standards, statutes, regulations, common law, and case law applying to case facts to render appropriate legal and ethical decisions.
- Attend trials, depositions, and mediations with defense counsel as needed for our entire territory.
- Handle or direct activity of assigned independent adjusters in all aspects of investigation and settlement of assigned claims to include interviewing insureds, witnesses, and physicians; inspecting property damage; reviewing factual information to prepare damage estimates; evaluating and making recommendations regarding coverage of claims; determining liability and total value of claims; negotiating settlements and making recommendations regarding litigation.
- Assign case to third-party vendors and experts as applicable for investigation of circumstances when compensability is questionable
- Make appropriate settlements in a timely manner with regards to all aspects of covered damages and appropriate applications of business considerations and needs, while proactively manages claim costs and expenses and manages litigation expenses within budget
- Analyze case facts to establish timely and accurate indemnity and expense reserves and identify possible fraud or abuse throughout course of claim.
- Complete accurate Large Loss and Litigation reports to executive management and reinsurers with timely updates.
- Prepare or direct appropriate counsel to prepare comprehensive, accurate, timely, and pertinent Reservation of Rights, coverage declination, and excess letters.
- Handle suits filed against the company that arise from claims or claims activities, always protecting the interest of the company against claims for extracontractual and punitive damages.
SKILLS to get the JOB done RIGHT:
- BA/BS degree from a regionally accredited university or college and 5-10 years of insurance claims and litigation experience with a carrier, independent adjusting firm, third-party administrator, or law firm, or an equivalent combination of education and relevant insurance experience.
- Adjuster license or the ability to obtain an adjuster license for assigned jurisdiction(s) is required
- Strong verbal and written communication, organizational, interpersonal, and problem-solving skills
- Proven ability to read and interpret insurance policies, including applying applicable case law and/or statutes as required to make appropriate policy interpretation
- Proven track record of handling complex, high-value claims and litigation
- Proficient in the use and knowledge of MS Office software
- Ability to travel up to at least 25% for mediations, trials, and other meetings
