Introduction
Maryland’s\r\nFamily and Medical Leave Insurance (FAMLI) program makes sure all workers in\r\nMaryland have paid time off for medical and family reasons. FAMLI is a social\r\ninsurance system covering 2.6 million workers and 180,000 employers, delivered\r\nas a digitally native, public-facing service. We’re in the early stages of\r\nbuilding something as big and as far-reaching as unemployment insurance or a\r\nnew health department. We know that delivering services primarily through a\r\nwebsite, over the Internet, is a new way of doing business in government.\r\nThe\r\nAppeals Unit is responsible for providing a fair and impartial process for\r\nreviewing\r\ndeterminations made by the\r\nFAMLI Division. Our Hearing Officers conduct hearings, review evidence, and issue legally sound\r\ndecisions while safeguarding due process. The Appeals Unit is committed to delivering timely,\r\naccessible, and high-quality service to workers, employers, and the\r\npublic while upholding the integrity of the FAMLI program.\r\nHearing Officers conduct administrative hearings\r\nand issue written decisions. They are responsible for managing hearings\r\nefficiently, developing a complete and accurate record,�and\r\napplying the law in an impartial manner. Main Purpose of Job
A Hearing Officer II is a full performance level position of the Appeals Unit within the\r\nDivision of Family and Medical Leave Insurance (FAMLI) at the Maryland Department of\r\nLabor. A Hearing Officer II ensures accurate and timely processing of appeals by reviewing\r\nappeals intakes, case materials, and evidence, conducting administrative hearings and pre-\r\nhearing conferences when necessary. Hearing Officers also communicate and coordinate with\r\nparties and participants in appeals hearings, and write and issue appeals decisions in\r\naccordance with the law.\r\n
POSITION DUTIES
Duties of this position\r\ninclude but are not limited to:\r\n\r\n\r\n�75% - Administrative Hearings and Decision Writing\r\n●\r\nConducts impartial administrative\r\nhearings related to the eligibility, benefits, and contribution liability under\r\nthe FAMLI program.�\r\n●\r\nReviews all pertinent facts surrounding\r\nthe hearing.�\r\n●\r\nReviews case materials, relevant\r\nstatutes, and evidence prior to the hearing.\r\n●\r\nFollows prescribed legal procedures and\r\nensures that due process is maintained throughout hearings.�\r\n●\r\nEvaluates testimony and applies statutes,\r\ncase law, and program regulations accurately.�\r\n\r\n●\r\nPrepares timely, legally sound, and\r\nclearly written proposed decisions.�\r\n●\r\nCollaborates effectively with Clerks,\r\nadministrators, and other team members in the Hearings Unit.��\r\n●\r\nEnsures confidentiality and proper\r\nhandling of sensitive information.��\r\n●\r\nRemains adaptable to new technologies and\r\nnew processes as they are introduced.��\r\n●\r\nAssists with appeals pre-review and\r\nintake to resolve and dispense of cases when possible.��\r\n●\r\nPerforms research in preparation for the\r\nadministrative hearings.\r\n\r\n●\r\nIssues pre-hearing orders, subpoenas,\r\nadministers oaths, examines witnesses and receives documentary evidence.\r\n●\r\nInstructs the parties of their rights.\r\n●\r\nConducts pre-hearing conferences to limit\r\nissues, combine parties and representation, accept stipulations, determine\r\norder of presentation and to address other aspects of the hearing.��\r\n�\r\n\r\n�20% - Maintain\r\nKnowledge of Rules and Procedures\r\n\r\n● Stays up-to-date on changes in administrative law, as well as FAMLI policies, procedures and regulations.\r\n● Participates in regular team trainings.\r\n\r\n\r\n\r\n�5% - Other��\r\n● Compiles\r\ndata and produces reports as directed.���\r\n●�Performs other duties as required.\r\n\r\n\r\n\r\n\r\n\r\n\r\n
MINIMUM QUALIFICATIONS
Education: A Juris Doctor degree or equivalent degree from an accredited law school. \r\nExperience: One year of legal experience involving civil, criminal, or administrative proceedings. \r\nNotes: \r\n1. Candidates may substitute U.S. Armed Forces military service experience as a commissioned officer in judge advocate classification or judge advocate specialty codes in the general attorney field of work on a year-for-year basis for the required education. \r\n
DESIRED OR PREFERRED QUALIFICATIONS
\r\n● Experience in paid leave, unemployment insurance, workers compensation, or any other benefits administration program is preferred.\r\n● Experience setting up new government programs is preferred.\r\n\r\n
LICENSES, REGISTRATIONS AND CERTIFICATIONS
1. Candidates for positions in this classification must have membership in the Bar of any state or federal jurisdiction at the time of hire and must become a member of the Maryland Bar within 12 months of hire. \r\n2. Employees in this classification may be assigned duties which require the operation of a motor vehicle. Employees assigned such duties will be required to possess a motor vehicle operator’s license valid in the State of Maryland. \r\n
SPECIAL REQUIREMENTS
All candidates are subject to a background check against files maintained by the Division of Unemployment Insurance (Labor/DUI) to determine whether any monies are owed to Labor/DUI as a result of unemployment insurance overpayment/fraud. Any unpaid debt may have an impact on whether or not a candidate is offered employment.\r\n
