We are seeking a talented senior product and regulatory lawyer to join our legal department. This role will report to the General Counsel. You will join a fast-paced, collegial, and innovative team, providing legal counsel to Prosper's product, business and operations teams, and leading the borrower-side of the business.
Serve as a senior advisor to the business on legal issues relating to our consumer platforms and general operations.
Lead the borrower-side legal team and provide advice to senior leaders regarding our personal loan and credit card programs
Work closely with Prosper’s product and technology team, advising on the development of new products and services.
Work alongside Prosper's Compliance team to design, develop and maintain processes and procedures.
Manage, review and update policies and legal agreements related to Prosper’s consumer platforms.
Manage litigation related to the operation of Prosper’s consumer platforms.
Represent Prosper with state and federal regulators; manage any enforcement actions, inquiries and investigations.
Support the General Counsel in Prosper’s government relations efforts, including research and support on state and federal public policy issues.
J.D. with solid academic credentials and a State bar member in good standing.
12+ years of relevant legal experience, including at least 3+ years in-house at a financial technology company, bank, or at a top-tier law firm (in-house experience preferred, but not required).
A demonstrated ability to understand business needs and to serve as a trusted advisor, providing sound, transparent legal advice.
Ability to balance legal risk with business objectives.
Exceptional interpersonal communication skills and an upbeat attitude.
Experience with financial services regulation, such as the Gramm-Leach-Bliley Act (GLBA), Fair Credit Reporting Act, (FCRA), Truth in Lending Act (TILA)/Regulation Z, Equal Credit Opportunity Act (ECOA)/Regulation B, Credit Card Accountability Responsibility and Disclosure (CARD) Act, Bank Secrecy Act (BSA), Telephone Consumer Protection Act (TCPA), Fair Debt Collection Practices Act (FDCPA), and Electronic Fund Transfer Act (EFTA)/Regulation E
