About the Role

We're looking for a seasoned product counsel to be Nex's primary legal partner to Product, Engineering, Trust & Safety, Design, and Marketing - advising across the full product lifecycle, with particular depth in privacy and children's privacy compliance. You will own Nex's privacy program day-to-day, including COPPA compliance, camera- and AI-driven data collection practices, and consent and disclosure flows, while also advising on consumer protection, IP, emerging AI regulation, and the broader mix of legal issues that come up as we ship new hardware features, games, and Play Pass content.

This is a senior, largely independent role for someone who wants to build a product legal function from scratch rather than plug into an existing one - you'll be writing our first privacy program, our first product-review processes, and our first AI governance approach, with real opportunity to grow this into a larger function as Nex scales.

Responsibilities

  • Own Nex's privacy program end-to-end: COPPA compliance, data mapping for our camera- and AI-driven product, vendor data processing agreements, and consent/disclosure flows for a product used heavily by children.
  • Draft, review, and maintain Nex's privacy policy, terms of service, and parental consent flows, including for new markets as we expand internationally (e.g., GDPR and other regional children's/data protection frameworks).
  • Advise Product, Engineering, Trust & Safety and Design on privacy-by-design principles and age-appropriate product experiences from ideation through launch.
  • Monitor the evolving children's privacy and online safety regulatory landscape (COPPA, state age-appropriate design laws, GDPR-K, and similar frameworks) and translate developments into actionable product guidance.
  • Serve as the point of contact for privacy incidents, regulatory inquiries, and data subject/parental requests, escalating appropriately to the GC and outside counsel.
  • Serve as the escalation point for Legal Operations and Commercial Counsel on any privacy or COPPA questions that surface in vendor, commercial, or operational contexts - they are trained to flag these to you rather than advise on them directly.
  • Be a trusted, embedded advisor to Product, Engineering, Trust & Safety, Design, and Marketing - reviewing new features, hardware capabilities, and AI/motion-detection functionality for legal risk from concept through launch.
  • Advise on consumer protection issues relevant to Play Pass and other subscription or in-product offerings, including disclosures, auto-renewal compliance, and promotions or sweepstakes tied to product launches or marketing campaigns.
  • Review product user experiences, in-app disclosures, and marketing/advertising materials to mitigate legal risk while supporting the team's goals.
  • Provide practical guidance on emerging AI regulation as it applies to Nex's computer vision and motion-detection technology, including responsible AI development and deployment considerations.
  • Flag physical product safety and liability considerations that arise from hardware feature design (e.g., camera/sensor placement, physical play mechanics, choking/impact hazards for young users) to the GC and outside counsel during feature review.
  • Support IP strategy for product innovation: facilitate invention harvesting and patent-strategy conversations with Engineering, and advise on trademark use in-product, in partnership with Legal Operations on portfolio docketing.
  • Build the playbooks, guides, and internal training that let Product, Engineering, and Marketing self-serve on lower-risk questions and escalate the right issues early.
  • Design a scalable legal review process for product launches that keeps pace with Nex's release cadence without becoming a bottleneck.
  • Partner with Legal Operations on intake triage and template design for product-related legal requests, and with Commercial Counsel to keep licensing/partnership agreements aligned with product privacy and IP commitments.
  • Manage outside counsel on specialized privacy, AI regulatory, product-safety, or IP matters as needed, with Legal Operations administering the underlying vendor relationship and spend.
  • As Nex scales, help define whether and how this function grows - this role has a credible path to leading a larger product legal team.
  • J.D. and active bar membership in good standing (California or another U.S. state, as applicable).
  • 4-7+ years of relevant legal experience, combining law firm and in-house product counseling at a technology or consumer products company.
  • Deep, hands-on experience with children's privacy compliance (COPPA, age-appropriate design frameworks, GDPR-K or similar) - this is the technical core of the role.
  • Experience advising product, engineering, and design teams throughout the full product development lifecycle, not just at launch review.
  • Working knowledge of consumer protection law as applied to subscriptions, promotions, and marketing claims.
  • Comfort advising on emerging AI/computer vision regulatory questions, even without a technical background, and genuine interest in the underlying technology.
  • A builder's mindset: comfortable creating playbooks, review processes, and governance frameworks from scratch rather than operating an existing one.
  • Excellent judgment translating complex legal and regulatory requirements into clear, actionable guidance for non-legal audiences under real deadlines.
  • Strong cross-functional relationship-building skills and a low-ego, collaborative approach.

Nice to Have

  • Privacy certification (CIPP/US, CIPP/E, or similar), or willingness to obtain one.
  • Experience in consumer hardware, consumer electronics, gaming, or toy/kids' products.
  • Experience supporting sweepstakes, contests, or promotions tied to consumer products or subscriptions.
  • Exposure to patent or trademark strategy in a product/engineering context.
  • Experience advising on international product launches and multi-jurisdictional compliance.
  • Product, Engineering, Trust & Safety, Design and Marketing have a legal partner they trust to move fast on new features and launches with confidence.
  • Nex has a documented, defensible privacy and children's data protection program that scales as the company grows and enters new markets.
  • Privacy, consumer protection, and AI regulatory issues are surfaced and resolved at the design stage, not after the fact.
  • Playbooks, templates, and review processes let the product organization self-serve on routine questions, freeing this role to focus on the highest-impact issues.
  • Nex is positioned to expand this function as the business grows, with this person as the natural lead.
